TERMS & CONDITIONS – FUEGA LABS S.A. DE C.V.

1. RESERVATIONS

All reservations must be made through our official platforms, including Instagram, WhatsApp Business, Fever, or Airbnb. Reservations may be made in-store; however, this is subject to availability at the time of inquiry. Reservations are only confirmed upon receipt of full payment, accompanied by proof of payment.

2. COMMUNICATION

FUEGA LABS S.A. DE C.V. responds to messages between 10:00 AM and 6:00 PM on weekdays and 12:00 PM and 6:00 PM on weekends. If our team is engaged in an event or activation, response times may be delayed.

3. REFUNDS & CANCELLATIONS

FUEGA LABS S.A. DE C.V. does not issue refunds under any circumstances. Only store credit or rescheduling options are available. Due to accounting policies, refunds are not possible, and this policy is clearly stated in our marketing materials to avoid misunderstandings. Cancellations will be credited as store credit, which must be used within two (2) weeks from the original reservation date. Rescheduling requests beyond two (2) weeks will be reviewed on a case-by-case basis and are subject to availability. If FUEGA LABS S.A. DE C.V. has a scheduling conflict, we will provide advance notice and reschedule accordingly. This does not entitle the participant to a refund. All cancellations and rescheduling requests must be submitted at least 24 hours prior to the scheduled reservation. Any notice provided less than 24 hours before the reservation will be considered a late cancellation, and rescheduling or store credit will not be granted.

4. WORKSHOP TERMS

FUEGA LABS S.A. DE C.V. and its employees are not responsible for any damage to the personal property of participants during the workshop. FUEGA LABS S.A. DE C.V. is not responsible if a participant is dissatisfied with the final product, as the customization process is entirely performed by the participant under artistic guidance. FUEGA LABS S.A. DE C.V. and its employees are not liable for any injuries or damages, including but not limited to burns, choking hazards, allergic reactions, or cuts, that may occur during the workshop. FUEGA LABS S.A. DE C.V. reserves the right to remove any participant engaging in inappropriate, unsafe, or disruptive behavior. Solicitation of FUEGA LABS S.A. DE C.V. team members is strictly prohibited and will result in immediate removal from the premises. Hate speech, racial slurs, nudity, or any inappropriate conduct will not be tolerated. Photos and videos may be taken during workshops, and participants may appear in published content. Please refer to our Use of Image Policy for further details. Workshops begin promptly with a 15-minute grace period. Participants arriving more than 30 minutes late may be subject to additional fees or denied participation. FUEGA LABS S.A. DE C.V. is not responsible for lost, stolen, or damaged personal property. While we will assist in resolving issues, we are not obligated to replace any items. Pricing is per participant and covers one (1) item per workshop. Additional customized items will incur additional charges. Theft or unauthorized removal of property will result in legal action, including police reports and penalties.

5. AFTER WORKSHOP POLICY

FUEGA LABS S.A. DE C.V. is not responsible for retouching or modifications to items created during workshops. Participants are responsible for the final outcome of their customizations, and post-workshop alterations are not included in the original workshop fee.

6. CHILDREN’S POLICY

FUEGA LABS S.A. DE C.V. is not responsible for any injuries, mishaps, or accidents involving children during workshops. Children under the age of 15 must be accompanied by a parent, relative, or responsible adult at all times. Inappropriate behavior will not be tolerated, regardless of the participant’s age.

7. SEXUAL HARASSMENT POLICY

7.1 POLICY STATEMENT

FUEGA LABS S.A. DE C.V. is committed to providing a workplace free from sexual harassment. We have a zero-tolerance policy against verbal, physical, or non-verbal sexual harassment. All employees, contractors, vendors, and visitors must comply with this policy. Sexual harassment is illegal and against company policy. Violations will result in disciplinary action, including termination of employment or business relationships.

7.2 DEFINITION OF SEXUAL HARASSMENT

Sexual harassment includes unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature when:

  • Quid Pro Quo: Submission to such conduct is explicitly or implicitly a condition of employment or career advancement.
  • Hostile Work Environment: Such conduct interferes with work performance or creates an intimidating, hostile, or offensive work environment.
7.3 EXAMPLES OF SEXUAL HARASSMENT
  • Verbal: Sexual jokes, inappropriate remarks about appearance, repeated unwanted advances, threats based on rejection.
  • Non-Verbal: Displaying suggestive content, staring, making inappropriate gestures, sending unwelcome messages.
  • Physical: Unwanted touching, blocking paths, any form of sexual assault.
  • Digital: Inappropriate messages, cyberstalking, unauthorized sharing of personal content.
7.4 REPORTING SEXUAL HARASSMENT

Individuals experiencing harassment should report it immediately to:

  1. Direct Supervisor
  2. Human Resources (HR)
  3. Anonymous Reporting Platform (if applicable) All reports are taken seriously and investigated promptly.
7.5 INVESTIGATION PROCESS

Upon receiving a complaint:

  1. Initial Review: HR conducts a confidential review.
  2. Interviews: Complainant, accused, and witnesses are interviewed.
  3. Evidence Collection: Emails, messages, security footage, and relevant documents are examined.
  4. Decision & Action: Appropriate disciplinary measures (warnings, suspension, termination) are taken.
  5. Follow-Up: Measures are implemented to prevent future incidents.
7.6 PREVENTION MEASURES

FUEGA LABS S.A. DE C.V. will:

  • Conduct annual harassment prevention training.
  • Maintain a clear and accessible reporting system.
  • Ensure HR and managers are trained to handle complaints professionally.
  • Foster a culture of respect and professionalism.
  • Take immediate action upon complaints.
7.7 DISCIPLINARY ACTIONS

Individuals found guilty of sexual harassment will face:

  • Verbal/Written Warnings
  • Mandatory Training
  • Suspension or Demotion
  • Termination
  • Legal Consequences, if applicable
7.8 LEGAL COMPLIANCE

This policy complies with:

  • Federal Labor Law (Ley Federal del Trabajo – LFT) and the National Council to Prevent Discrimination (Consejo Nacional para Prevenir la Discriminación – CONAPRED).
  • Title VII of the Civil Rights Act
  • ILO Workplace Harassment Standards
  • Applicable Mexican labor laws
